VPS Acceptable Use Policy (AUP)

This Acceptable Use Policy (AUP) defines prohibited uses of CrossTrade VPS Hosting Services. By using VPS Services, you agree to comply with this AUP in addition to all other Terms of Service. Violation of this AUP may result in immediate suspension or termination of your VPS Services without notice or refund.

CrossTrade reserves the right to investigate suspected violations and cooperate with law enforcement authorities. This AUP should be read in conjunction with the VPS Terms of Service, VPS Privacy Policy Addendum, and the CrossTrade Terms of Service.

1. Illegal Activities

You may not use VPS Services for any illegal purpose or in violation of any applicable laws. Prohibited illegal activities include but are not limited to the following categories.

Content Crimes

  • Hosting, distributing, transmitting, or linking to child sexual abuse material (CSAM)
  • Hosting or distributing pirated software, movies, music, or other copyrighted content without authorization
  • Hosting or distributing obscene or illegal pornographic content
  • Hosting content that violates intellectual property rights, trademarks, or trade secrets

Financial Crimes

  • Money laundering or terrorist financing
  • Operating unlicensed gambling services
  • Running Ponzi schemes, pyramid schemes, or other fraudulent investment programs
  • Credit card fraud, identity theft, or financial fraud
  • Operating illegal cryptocurrency exchanges or money transmission services

Cybercrime

  • Hosting or distributing malware, viruses, trojans, ransomware, spyware, or rootkits
  • Operating command-and-control (C2) servers for botnets
  • Hosting phishing websites or spoofed domains
  • Distributing exploit kits or hacking tools for malicious purposes
  • Participating in or facilitating ransomware attacks

Other Illegal Activities

  • Drug trafficking or illegal pharmaceutical distribution
  • Human trafficking or exploitation
  • Sale of illegal weapons or regulated items
  • Violating export control laws or distributing controlled technology
  • Stalking, harassment, or threats of violence
  • Any activity that violates federal, state, or local criminal laws
Illegal activities will result in immediate account termination, permanent ban, and reporting to law enforcement. CrossTrade will fully cooperate with criminal investigations.

2. Network Abuse and Attacks

You may not use VPS Services to disrupt, attack, or compromise networks, systems, or services.

Attacks on Third Parties

  • Launching denial-of-service (DoS) or distributed denial-of-service (DDoS) attacks
  • Port scanning, vulnerability scanning, or network probing without explicit authorization
  • Attempting to gain unauthorized access to systems (hacking, brute-force attacks, etc.)
  • Exploiting vulnerabilities in third-party systems
  • Packet flooding, SYN floods, or other network-level attacks

Attacks on CrossTrade or Other Customers

  • Attempting to access other customers' VPS instances
  • Interfering with CrossTrade infrastructure or services
  • Attempting to bypass security measures, firewalls, or access controls
  • Exploiting vulnerabilities in CrossTrade systems
  • Using your VPS to attack or scan other VPS instances on CrossTrade's network

Network Abuse Infrastructure

  • Operating open proxies, open relays, or VPN services without prior authorization
  • Running TOR exit nodes
  • Operating DNS amplification services
  • Running IRC bots used for DDoS attacks
  • Hosting exploit databases or attack tools for distribution
Enforcement: Network abuse will result in immediate suspension, investigation, and likely permanent termination. CrossTrade may provide your information to affected parties and law enforcement.

3. Spam and Unsolicited Communications

You may not use VPS Services to send or facilitate spam or unsolicited communications.

Email Spam

  • Sending unsolicited bulk email (spam) to recipients who have not opted in
  • Operating mail servers for spam distribution
  • Sending email marketing without proper consent and unsubscribe mechanisms
  • Using purchased, scraped, or harvested email lists
  • Forging email headers or engaging in email spoofing
  • Operating "mailer" scripts or bulk email software for spam purposes

Other Communication Spam

  • SMS/text message spam
  • Social media spam or automated posting
  • Blog comment spam or forum spam
  • Robocalls or automated voice spam
  • Messaging app spam (WhatsApp, Telegram, etc.)

Spam Infrastructure

  • Hosting websites advertised via spam
  • Operating redirect domains for spam campaigns
  • Providing bulletproof hosting for spammers
  • Running mail servers with open relays
  • Hosting email lists obtained through spam or scraping

Spam is defined as unsolicited bulk communications sent to recipients who have not explicitly opted in to receive them. Even if you believe your messages are legitimate, if they meet the definition of spam or violate anti-spam laws (CAN-SPAM Act, GDPR, etc.), they are prohibited.

Enforcement: Spam violations will result in immediate suspension and likely termination. Repeat offenders will be permanently banned. Spam complaints may be reported to blacklist authorities and anti-spam organizations.

4. Resource Abuse

You may not use VPS resources in ways that are excessive, unreasonable, or harmful to CrossTrade's infrastructure or other customers.

Cryptocurrency Mining

Cryptocurrency mining of any kind is strictly prohibited. This includes but is not limited to Bitcoin, Ethereum, Monero, or any other cryptocurrency mining, running mining software even if not actively mining, participating in mining pools, and providing compute power for mining services.

Cryptocurrency mining is only permitted if explicitly authorized in writing by CrossTrade and included in a specialized plan designed for compute-intensive tasks.

Excessive CPU/RAM Usage

  • Running applications that continuously consume 90% or more of CPU for extended periods (30+ days) without legitimate need
  • Running memory-intensive applications that cause resource contention for other customers
  • Operating compute farms or distributed computing for non-trading purposes
  • Running stress tests or benchmarking tools that impact host performance

Excessive Storage I/O

  • Running applications that generate excessive disk I/O operations
  • Operating databases with extremely high write operations
  • Running continuous file read/write operations that degrade storage performance
  • Using your VPS primarily for file storage rather than compute purposes

Bandwidth Abuse

  • Operating file-sharing services, torrent clients, or peer-to-peer file distribution
  • Streaming or hosting video/audio content for public consumption
  • Running high-bandwidth applications unrelated to trading or automation
  • Intentionally consuming bandwidth to reach limits or prevent other customers' access

Reselling or Subletting

  • Reselling VPS resources or access to third parties
  • Operating a hosting business using CrossTrade VPS Services
  • Providing "VPS as a Service" to other users
  • Allowing multiple unrelated individuals to access your VPS for commercial purposes

You may allow employees, contractors, or service providers to access your VPS for legitimate business purposes related to your own trading or automation activities.

Enforcement: Resource abuse will result in throttling, suspension, or forced upgrade requirements. Repeated violations will result in termination.

5. Copyright Infringement and DMCA Violations

You may not use VPS Services to host, distribute, or facilitate access to content that infringes intellectual property rights.

Infringing Content

  • Hosting pirated movies, TV shows, or video content
  • Hosting pirated software, games, or applications
  • Hosting pirated music, albums, or audio content
  • Hosting pirated ebooks, courses, or educational materials
  • Providing access to copyrighted content without authorization

Infringing Services

  • Operating torrent trackers or torrent indexing sites
  • Operating file locker services that primarily host pirated content
  • Running "warez" sites or software distribution sites
  • Operating streaming sites for pirated content
  • Providing links to or indexes of pirated content

DMCA Process

If CrossTrade receives a valid DMCA takedown notice related to content on your VPS:

  • CrossTrade will forward the notice to you via email
  • You must remove the infringing content within 24 hours
  • Failure to remove content will result in suspension or termination
  • Repeated DMCA notices will result in permanent account termination under CrossTrade's repeat infringer policy

You may file a DMCA counter-notice if you believe content was removed in error, following the procedures outlined in the CrossTrade Terms of Service.

Enforcement: DMCA violations will result in required content removal, potential suspension, and termination for repeat infringers.

6. Content Violations

You may not host content that violates CrossTrade's content policies.

Harmful or Dangerous Content

  • Content that promotes, encourages, or provides instructions for self-harm, suicide, or eating disorders
  • Content that promotes violence, terrorism, or extremism
  • Content providing instructions for making weapons, explosives, or dangerous devices
  • Content promoting dangerous challenges or activities that could cause harm

Hate Speech and Harassment

  • Content that promotes hate speech based on race, religion, ethnicity, national origin, disability, gender, sexual orientation, or other protected characteristics
  • Content that harasses, threatens, or incites violence against individuals or groups
  • Doxxing or publishing private information about individuals without consent
  • Content that promotes discrimination or violence

Fraudulent or Deceptive Content

  • Phishing pages or websites designed to steal credentials or information
  • Fake login pages impersonating legitimate services
  • Scam websites or fraudulent investment schemes
  • Fake news sites or disinformation campaigns
  • Counterfeit product sales or trademark violations

Adult Content Restrictions

  • Illegal pornography (child abuse material, revenge porn, non-consensual content)
  • Prostitution or escort services in jurisdictions where illegal
  • Adult content that violates obscenity laws

Legal adult content for personal use is generally permitted but must comply with all applicable laws and must not be distributed publicly or commercially without proper age verification and compliance with 18 U.S.C. § 2257.

Enforcement: Content violations will result in required content removal, suspension, or termination depending on severity.

7. Security and Unauthorized Access

You are responsible for securing your VPS and may not engage in activities that compromise security.

Failure to Secure Your VPS

  • Using weak or default passwords
  • Failing to install critical security updates for extended periods
  • Leaving services exposed to the internet without proper authentication
  • Running known-vulnerable software without mitigation

While these are poor practices, they typically result in warnings and required remediation rather than immediate termination.

Unauthorized Access

  • Attempting to access CrossTrade's infrastructure or other customers' VPS instances
  • Sharing access credentials with unauthorized parties
  • Allowing your VPS to be compromised and used for malicious purposes without taking corrective action
  • Operating honeypots or intentionally insecure systems to capture credentials

Circumventing Controls

  • Attempting to bypass resource limits or restrictions
  • Modifying system files or configurations to gain unauthorized access
  • Interfering with CrossTrade's monitoring or security systems
  • Using VPN or proxy services to evade IP-based restrictions
Enforcement: Security violations range from required remediation to immediate termination depending on severity and intent.

8. Prohibited Business Activities

Certain business activities are prohibited even if otherwise legal.

High-Risk Financial Services

  • Unlicensed money transmission or payment processing
  • Unlicensed investment advisory services
  • Pump-and-dump schemes or market manipulation
  • Operating unregistered securities exchanges

Restricted Services

  • Operating online casinos or gambling services without proper licensing
  • Pharmaceutical sales without proper licensing
  • VPN or proxy services without prior authorization
  • Adult content distribution without proper compliance
  • Crowdfunding platforms without proper compliance

Trading-Related Restrictions

  • Operating "signal" services that provide investment advice without proper licensing (note: CrossTrade's Signal Share feature is a technical tool for transmitting signals and does not constitute investment advice — users who distribute signals to third parties are solely responsible for determining and complying with applicable regulatory requirements)
  • Running "pay-to-pass" prop firm evaluation services
  • Operating copy-trading services that may violate securities laws
  • Providing trade execution services without broker-dealer registration
Enforcement: Prohibited business activities will result in immediate termination even if your specific operations are legal in your jurisdiction.

9. Compliance with Third-Party Policies

If you use your VPS to connect to third-party services (trading platforms, brokers, prop firms, etc.), you are solely responsible for complying with their terms of service and acceptable use policies. CrossTrade is not responsible for violations of third-party policies. If a third party reports that your VPS is violating their policies, CrossTrade may suspend or terminate your service to avoid liability.


10. Reporting and Enforcement

Reporting Violations: If you become aware of AUP violations by other CrossTrade users, report them to [email protected].

When CrossTrade receives abuse complaints or detects AUP violations:

  • CrossTrade will investigate the complaint or suspected violation
  • CrossTrade may suspend your VPS immediately if the violation is severe or poses risk to infrastructure
  • CrossTrade will notify you via email of the violation and provide details where feasible
  • You will be required to remedy the violation within a specified timeframe (typically 24–48 hours)
  • Failure to remedy the violation will result in termination

If you believe your VPS was suspended or terminated in error, you may appeal by contacting [email protected] with a detailed explanation. Appeals are reviewed on a case-by-case basis. CrossTrade's decision is final. Suspensions or terminations for AUP violations do not entitle you to refunds for unused service time.


11. Cooperation with Law Enforcement

CrossTrade LLC cooperates fully with law enforcement agencies and may provide customer information, logs, or VPS data in response to:

  • Valid subpoenas, court orders, or search warrants
  • Requests from law enforcement regarding ongoing criminal investigations
  • National security letters or other government requests
  • DMCA subpoenas related to copyright infringement

CrossTrade may suspend or terminate your VPS pending law enforcement investigation without notice.


12. Modification of AUP

CrossTrade may modify this Acceptable Use Policy at any time. Material changes will be communicated via email. Your continued use of VPS Services after changes are posted constitutes acceptance of the updated AUP.


13. Examples of Acceptable Use

To provide clarity, the following uses are generally acceptable:

Trading and Automation

  • Running NinjaTrader, TradingView, or other trading platforms
  • Operating automated trading strategies and algorithms
  • Hosting trade copier tools or automation software
  • Connecting to broker APIs for trade execution
  • Running backtesting or strategy development tools

Business and Productivity

  • Hosting business applications or databases for personal/business use
  • Running development environments or testing infrastructure
  • Operating monitoring tools or analytics software
  • Hosting private file storage for business documents
  • Running remote desktop for business productivity applications

Personal Use

  • Web browsing and general internet access
  • Running personal projects or applications
  • Hosting small-scale websites or blogs (non-commercial)
  • Running game servers for private use with friends (within resource limits)
