VPS Services provide allocated server resources including CPU, RAM, storage, and network bandwidth as specified in your selected service plan.
CrossTrade reserves the right to modify resource allocations, specifications, and pricing for VPS plans with 30 days' notice to active subscribers, upgrade server hardware, operating systems, or infrastructure without prior notice, migrate your VPS to different physical hardware for maintenance, load balancing, or operational purposes, and change the geographic location of servers with reasonable notice where feasible.
Resource specifications listed for each VPS plan are allocations, not guarantees. Actual performance may vary based on server load, network conditions, and your specific usage patterns. CrossTrade uses reasonable commercial efforts to provide the stated resources but makes no warranties regarding performance, speed, or benchmarks.
You acknowledge that CrossTrade acts as a reseller of infrastructure provided by third-party data centers. CrossTrade is not responsible for actions taken by these upstream providers, including physical server relocation or region retirement.
CrossTrade is not liable for any financial losses, missed trading opportunities, or execution failures resulting from VPS downtime, latency, or connectivity issues.
You agree not to use VPS Services for any unlawful purpose or in any way that violates this Acceptable Use Policy. Prohibited activities include, but are not limited to, the following categories of conduct.
Illegal activities are strictly prohibited, including hosting, distributing, or transmitting illegal content including pirated software, copyrighted materials without authorization, or child sexual abuse material, engaging in or facilitating illegal gambling, money laundering, fraud, or other criminal activities, violating export control laws or regulations, and hosting or distributing malware, viruses, ransomware, or other malicious software.
Network abuse is prohibited and includes port scanning, network probing, or vulnerability scanning of third-party systems without explicit authorization, launching denial-of-service (DoS) or distributed denial-of-service (DDoS) attacks, operating open proxies, open relays, or TOR exit nodes, and engaging in any activity that disrupts or interferes with CrossTrade's network, servers, or other customers' services.
Resource abuse includes cryptocurrency mining of any kind unless explicitly permitted in writing by CrossTrade, operating file-sharing or torrenting services that consume excessive bandwidth, using automated scripts or bots that generate excessive server load, reselling VPS resources or operating a hosting business without CrossTrade's written consent, and running applications that intentionally consume resources beyond your allocated limits to degrade service for other customers.
Spam and unsolicited communications are prohibited, including sending unsolicited bulk email (spam), SMS messages, or other communications, operating mail servers for spam distribution, and hosting websites or services that promote or facilitate spam.
Content violations include hosting content that infringes intellectual property rights, including DMCA violations, hosting phishing websites, spoofed websites, or fraudulent content, and operating illegal adult content services or services that violate applicable obscenity laws.
Other prohibited uses include using VPS Services to stalk, harass, or harm other individuals, attempting to gain unauthorized access to CrossTrade systems or other customers' servers, interfering with or disrupting the integrity or performance of VPS Services, and circumventing or attempting to circumvent any security measures, usage limits, or access controls.
CrossTrade reserves the right to immediately suspend or terminate VPS Services and your account without notice or refund if you engage in any prohibited activity. CrossTrade may report illegal activities to appropriate law enforcement authorities and cooperate fully with any investigations.
CrossTrade strives to provide reliable VPS Services but makes no guarantees regarding uptime, availability, or uninterrupted service.
VPS Services are provided on an "as available" basis. CrossTrade does not provide Service Level Agreements (SLAs) or uptime guarantees. Your VPS may experience downtime due to scheduled maintenance (CrossTrade will provide notice when feasible), emergency maintenance or security patches, hardware failures, network outages or connectivity issues, DDoS attacks or other malicious activities, force majeure events, or your own actions such as misconfigurations or resource exhaustion.
CrossTrade may perform scheduled maintenance that requires VPS downtime. Where possible, CrossTrade will provide at least 24 hours' notice via email. Emergency maintenance may be performed without notice when necessary to maintain security or service integrity.
CrossTrade does not provide refunds, credits, or compensation for VPS downtime, service interruptions, or degraded performance, regardless of cause or duration. This includes downtime caused by CrossTrade's actions, third-party providers, or circumstances beyond CrossTrade's control.
Each VPS plan includes specified resource allocations for CPU, RAM, storage, and bandwidth. You are responsible for monitoring your resource usage and ensuring it remains within your plan's limits.
CrossTrade monitors resource usage across all VPS instances. If your usage consistently exceeds your plan's allocations, CrossTrade may throttle your VPS performance to prevent impact on other customers, require you to upgrade to a higher-tier plan within 7 days, suspend your VPS if you refuse to upgrade or if excessive usage continues, or terminate your service for repeated violations with 3 days' notice.
Even within your resource allocations, you agree to use VPS resources reasonably and in good faith. CrossTrade reserves the right to investigate and take action against users who use 90% or more of allocated resources continuously for extended periods (30+ days) in ways that impact server performance, run applications or processes that create excessive I/O operations, degrading storage performance for other users, or generate disproportionate support tickets or require excessive technical intervention.
Bandwidth allocations are measured monthly and reset at the beginning of each billing cycle. If you exceed your monthly bandwidth allocation, additional bandwidth may be billed at CrossTrade's then-current overage rates, your VPS may be throttled to reduced speeds for the remainder of the billing cycle, and repeated overages may require an upgrade to a higher-tier plan.
Storage limits include all data on your VPS: operating system, applications, files, databases, logs, and backups (if you create local backups). You are responsible for managing storage usage. CrossTrade is not responsible for data loss due to storage exhaustion.
You are solely responsible for backing up all data stored on your VPS. CrossTrade does not provide backup services, automatic backups, or data recovery services unless explicitly included in your service plan and documented in writing.
CROSSTRADE IS NOT LIABLE FOR ANY DATA LOSS, CORRUPTION, OR DELETION, REGARDLESS OF CAUSE. This includes but is not limited to data loss resulting from hardware failures, software errors or bugs, your actions or misconfigurations, malicious attacks or security breaches, account termination or suspension, service discontinuation, or natural disasters or force majeure events.
Upon termination or cancellation of VPS Services, CrossTrade will retain your VPS data for a maximum of 7 days. After 7 days, all data will be permanently deleted and cannot be recovered. It is your responsibility to retrieve all data before termination or within the 7-day grace period.
While CrossTrade implements reasonable security measures at the infrastructure level, you are responsible for securing your VPS, including maintaining strong passwords and secure authentication methods, applying operating system and software security updates, configuring firewalls and security settings appropriately, monitoring for unauthorized access or suspicious activity, and encrypting sensitive data as appropriate. CrossTrade is not responsible for security breaches, unauthorized access, or data theft resulting from your failure to properly secure your VPS.
VPS Services are billed on a monthly or annual basis as selected during checkout. Billing cycles begin on the date your VPS is initially provisioned. VPS subscriptions automatically renew at the end of each billing period unless you cancel before the renewal date. You authorize CrossTrade to charge your payment method on file for renewal payments.
CrossTrade reserves the right to modify VPS pricing at any time. Price changes for existing subscriptions will take effect at your next renewal date following 30 days' notice via email.
If payment fails or is not received by the due date, your VPS will be suspended after 3 days of non-payment, suspended VPS instances remain inaccessible until payment is received, and VPS instances suspended for 14 or more days may be terminated and all data permanently deleted.
VPS Services are non-refundable. No refunds or credits are provided for partial months of service, unused time on monthly or annual subscriptions, service cancellations, account terminations (voluntary or involuntary), downtime or service interruptions, or dissatisfaction with performance or features. This no-refund policy applies even if you are unsatisfied with VPS performance, cancel within days of signing up, or experience extended service outages. Certain VPS plans may include one-time setup fees. Setup fees are non-refundable under all circumstances.
CrossTrade may immediately suspend your VPS without notice if you violate this Acceptable Use Policy, your VPS is involved in malicious activity, spam, or abuse, CrossTrade receives abuse complaints, DMCA notices, or legal demands related to your VPS, your payment fails or your account is past due, your resource usage severely impacts other customers, or CrossTrade reasonably believes suspension is necessary to protect its infrastructure or other customers.
CrossTrade may terminate your VPS Services and account with or without notice if you repeatedly violate these Terms of Service or the Acceptable Use Policy, your VPS is used for illegal activities, you fail to cure a suspension-triggering issue within a reasonable timeframe, you attempt to circumvent security measures, usage limits, or access controls, or CrossTrade determines, in its sole discretion, that continuing service poses legal, financial, or reputational risk.
You may cancel VPS Services at any time by following the cancellation process in your account dashboard or by contacting CrossTrade support. Cancellations are effective at the end of your current billing period. No refunds are provided for early cancellation.
Upon termination or cancellation, you immediately lose access to your VPS, all services are discontinued, your data will be retained for up to 7 days and then permanently deleted, and all amounts owed to CrossTrade become immediately due. You remain liable for any outstanding charges and responsible for all indemnification obligations.
You agree to defend, indemnify, and hold harmless CrossTrade, its upstream providers, and affiliates from any claims, damages, losses, or expenses (including legal fees) arising from your use of the VPS Services, your violation of these Terms, or your violation of any third-party rights.
CrossTrade complies with the Digital Millennium Copyright Act (DMCA). If CrossTrade receives a valid DMCA takedown notice related to content hosted on your VPS, CrossTrade will forward the notice to you via email, require you to remove the infringing content within 24 hours, suspend or terminate your VPS if you fail to remove infringing content, and cooperate with copyright holders and law enforcement as required by law. You are solely responsible for ensuring content hosted on your VPS does not infringe third-party intellectual property rights.
If CrossTrade receives abuse complaints related to your VPS (e.g., spam complaints, hacking attempts, malicious activity), CrossTrade will investigate and may immediately suspend your VPS pending investigation, require you to address and remedy the issue within a specified timeframe, terminate your service if abuse is confirmed or if complaints are severe or repeated, or provide your information to complainants, law enforcement, or other authorities as required by law.
CrossTrade maintains a repeat infringer policy. Users who receive multiple DMCA notices or abuse complaints may have their accounts permanently terminated without refund.
Each VPS is assigned one or more IP addresses as specified in your service plan. IP addresses remain the property of CrossTrade and are licensed to you solely for use with your VPS Services. CrossTrade reserves the right to change your assigned IP address(es) at any time for operational, security, or administrative reasons. CrossTrade will provide reasonable notice when feasible, but IP addresses may be changed without notice if necessary.
You are responsible for maintaining the reputation of assigned IP addresses. If your IP address becomes blacklisted due to your activities (e.g., spam, abuse), you are responsible for delisting efforts. CrossTrade may assign you a different IP address but makes no guarantees regarding IP reputation. Additional IP addresses may be available for purchase depending on your plan and availability. CrossTrade reserves the right to refuse additional IP address requests or require justification for additional IPs.
Provided Software: CrossTrade provides VPS instances with a base operating system installation as specified in your plan (e.g., Windows Server). CrossTrade is not responsible for:
• Installing or configuring additional software or applications
• Maintaining software updates or patches beyond initial OS installation
• Troubleshooting software conflicts or compatibility issues
• Providing licenses for third-party software (you must provide your own licenses)
Software Updates: You are responsible for installing operating system updates, security patches, and software updates on your VPS. CrossTrade may install critical security patches at the infrastructure level but is not responsible for maintaining your VPS operating system or applications.
Licensing: You are responsible for ensuring all software installed on your VPS is properly licensed. CrossTrade does not provide software licenses except where explicitly included in your service plan. You agree to indemnify CrossTrade for any claims related to unlicensed or pirated software on your VPS.
CrossTrade provides limited technical support for VPS Services, including VPS provisioning and initial access, network connectivity issues originating from CrossTrade's infrastructure, hardware failures affecting your VPS, and account and billing questions.
CrossTrade support does NOT include operating system configuration or troubleshooting, software installation, configuration, or troubleshooting, application debugging or development assistance, performance optimization or tuning, security hardening or malware removal, data recovery or backup restoration, or training on how to use Windows, Linux, or specific applications.
CrossTrade does not guarantee support response times. Support requests are handled on a best-effort basis during normal business hours (Monday-Friday, 9 AM - 5 PM Mountain Time, excluding holidays). Critical infrastructure issues affecting multiple customers will be prioritized. VPS support is provided via email at [email protected]. CrossTrade does not provide phone support, live chat, or on-demand remote assistance for VPS Services.
CrossTrade retains the right to access your VPS for the following purposes: performing maintenance, updates, or security patches, investigating abuse complaints or Terms of Service violations, diagnosing technical issues at your request, complying with legal obligations, court orders, or law enforcement requests, and ensuring infrastructure security and preventing malicious activity. CrossTrade will not access your VPS or review your data except as necessary for the purposes listed above.
CrossTrade monitors infrastructure-level metrics including CPU usage, RAM usage, bandwidth consumption, and disk I/O. CrossTrade does not monitor the content of your files or communications except as necessary to investigate abuse or comply with legal obligations.
CrossTrade does not provide data migration services, file transfer assistance, or help moving data from other providers to your VPS. You are solely responsible for migrating any data, applications, or configurations to your VPS.CrossTrade may provide documentation or general guidance for common migration tasks but is not responsible for executing migrations or troubleshooting migration-related issues.
CrossTrade reserves the right to modify, suspend, or discontinue VPS Services (in whole or in part) at any time with or without notice. This includes but is not limited to:
• Discontinuing specific VPS plans or configurations
• Removing features or changing service specifications
• Retiring hardware or infrastructure
• Exiting the VPS hosting business entirely
If CrossTrade discontinues VPS Services, CrossTrade will provide at least 30 days' notice to active subscribers and will allow you to retrieve your data before final termination. No refunds will be provided for discontinued services beyond unused time on monthly subscriptions calculated on a pro-rata basis, at CrossTrade's sole discretion.
Your VPS may interact with third-party services, APIs, or software not provided by CrossTrade. CrossTrade is not responsible for the availability, performance, security, or legality of any third-party services. You use third-party services at your own risk.
IN ADDITION TO ALL OTHER DISCLAIMERS IN THESE TERMS OF SERVICE:
• CrossTrade makes no warranties regarding VPS performance, speed, uptime, or reliability
• CrossTrade does not guarantee compatibility with any specific software or trading platforms
• CrossTrade is not responsible for data loss, corruption, or security breaches
• CrossTrade does not guarantee specific geographic locations or latency metrics VPS Services may not be suitable for high-frequency trading, mission-critical applications, or applications requiring guaranteed uptime
IN ADDITION TO ALL OTHER LIMITATIONS OF LIABILITY IN THESE TERMS OF SERVICE:
CrossTrade's total liability for any claims related to VPS Services is limited to the amount paid by you for VPS Services in the 30 days preceding the claim, or $50 USD, whichever is less.
CrossTrade is not liable for any losses, damages, or expenses resulting from:
• VPS downtime or unavailability
• Data loss or corruption
• Security breaches or unauthorized access
• Performance issues or slow speeds
• Resource limitations or throttling
• Third-party attacks or malicious activity
• Your misconfiguration or misuse of VPS Services
