AI Trading Agents Disclaimer

Disclaimer specifically related to the risks of authorizing third-party AI agents (via the Model Context Protocol, "MCP", or any equivalent integration) to access your CrossTrade account, execute trades, manage strategies, or query account state on your behalf.

This disclaimer supplements the CrossTrade Terms of Service, the Trading Disclaimer, and the Privacy Policy. By connecting any AI client (including but not limited to Claude, ChatGPT, Gemini, or any other Large Language Model or autonomous agent) to your CrossTrade account, you acknowledge that you have read, understood, and agreed to this AI Trading Agents Disclaimer in addition to all other governing agreements.

Authorization and Scope of Agent Access

CrossTrade's MCP integration allows you to grant a third-party AI client OAuth-scoped access to your CrossTrade account. When you complete the OAuth consent flow, you authorize that AI client to invoke the CrossTrade tools you have approved on your behalf. The scope of access is limited to the tool surface declared at consent time, but within that scope the AI client may take actions including, without limitation, placing, modifying, and cancelling orders; enabling, disabling, and starting strategies; querying account balances, positions, and execution history; managing watchlists; and reading or generating trade journal entries.

You are solely responsible for understanding the scope of access you grant. You may revoke access to any connected AI client at any time through your CrossTrade account settings. Revocation invalidates any outstanding tokens for that client. Until you revoke access, every action taken by an authorized AI client in your account is deemed an action taken by you.


Third-Party AI Providers and Data Transmission

The AI clients you connect to CrossTrade are operated by independent third parties (for example, Anthropic, OpenAI, Google, and others). When you direct an AI client to interact with your CrossTrade account, account context, tool-call payloads, and any prompts or instructions you provide may be transmitted to and processed by those third-party AI providers. CrossTrade does not control how those third parties collect, retain, use, or further disclose that data. Each AI provider's privacy policy, terms of service, and data-handling practices govern their treatment of that information.

By connecting any AI client to your CrossTrade account, you consent to the transmission of relevant account context, prompts, and tool-call payloads to that third-party provider, and you accept full responsibility for that provider's handling of your data.

AI Output Is Not Investment Advice

Output produced by any AI client connected to CrossTrade (including but not limited to trade recommendations, market commentary, strategy suggestions, position sizing guidance, risk assessments, or execution decisions) is not investment advice, is not a recommendation to buy or sell any security or instrument, and is not a determination of suitability for your financial circumstances. AI clients are not fiduciaries. AI clients do not know your full financial situation, risk tolerance, account-type restrictions, regulatory status, tax position, or trading objectives, and they do not perform any suitability analysis on your behalf.

CrossTrade is a technology platform. CrossTrade is not registered with the National Futures Association (NFA), the Commodity Futures Trading Commission (CFTC), the Securities and Exchange Commission (SEC), or any other regulatory body as an introducing broker, commodity trading advisor, registered investment advisor, or in any other capacity. Connecting an AI client to CrossTrade does not change that status. The AI client is your tool. You are the trader. You alone are responsible for evaluating any output before acting on it.


Accuracy, Hallucination, and Model-Error Risk

Large Language Models and AI agents can produce output that is factually incorrect, internally inconsistent, fabricated, or contextually wrong. This phenomenon (commonly referred to as "hallucination") is an inherent characteristic of current AI systems. CrossTrade does not validate, fact-check, or guarantee the accuracy of any AI-generated content, instruction, or trading decision.

By way of example and not limitation, an AI client may:

  • Misread or misinterpret your prompt, leading to unintended trades.
  • Invent instruments, accounts, strategies, or order parameters that do not exist or that do not match your intent.
  • Misremember prior context within a conversation and act on outdated assumptions.
  • Submit malformed, oversized, undersized, or otherwise incorrect orders.
  • Repeat or duplicate actions due to model error, tool-call retry behavior, or ambiguous instructions.
  • Fail to follow safety instructions you have given, including instructions to stop trading or to confirm before acting.

CrossTrade processes whatever tool calls a connected AI client submits, within the scope of the OAuth grant you authorized. CrossTrade does not second-guess the AI's decisions. You are responsible for monitoring the AI's behavior in your account at all times and for intervening (including by revoking access) if the AI is behaving incorrectly.

NEVER ASSUME THE AI IS CORRECT. NEVER LEAVE AN AI AGENT UNSUPERVISED IN A LIVE TRADING ACCOUNT WITH MEANINGFUL CAPITAL AT RISK. CROSSTRADE LLC IS NOT LIABLE FOR ANY LOSSES, DAMAGES, OR ACCOUNT CONSEQUENCES ARISING FROM AI-GENERATED OUTPUT OR AI-INITIATED ACTIONS, REGARDLESS OF THEIR CAUSE.

User Responsibility for AI-Directed Trades

Every order, strategy change, account modification, or other action taken by a connected AI client is your action. CrossTrade serves only as a technical conduit between the AI client and your broker. You retain full and exclusive responsibility for:

  • The decisions you ask the AI client to make.
  • The prompts and context you supply.
  • The accuracy of any account state the AI relies on.
  • Reviewing, monitoring, and where necessary correcting AI-initiated activity in your account.
  • Compliance with all applicable broker terms, exchange rules, and securities or commodities regulations in your jurisdiction.
  • Tax reporting and recordkeeping for AI-initiated trades.

CrossTrade is not your supervisor, your broker, or your risk manager. If you grant an AI client access to your account, you assume the risks of that decision in full.


Prohibited Uses of AI Agents

You may not use a connected AI client to engage in any activity that is otherwise prohibited by the CrossTrade Terms of Service or by applicable law. Without limiting the foregoing, the following uses are expressly prohibited and may result in immediate suspension or termination of your account and revocation of all connected AI integrations, with or without notice:

  • Market manipulation, including wash trading, spoofing, layering, or coordinated price manipulation.
  • Use of CrossTrade with proprietary trading firm accounts, funded trader programs, or evaluation accounts in violation of those firms' terms of service (see also the Prop Firm clauses in the Terms of Service and Trading Disclaimer).
  • Attempts to extract data belonging to other CrossTrade users, to bypass CrossTrade's authentication, rate limiting, or scope restrictions, or to enumerate internal endpoints not exposed by the MCP tool surface.
  • Automated submission of high-frequency requests intended to degrade service or to extract benefits not available to ordinary users.
  • Use of AI-generated output to provide investment advice, signals, or managed-account services to third parties unless you are properly licensed and registered to do so in every applicable jurisdiction.
  • Reverse engineering, model probing, or prompt injection attacks intended to manipulate CrossTrade's own AI integrations or downstream AI providers.

You are solely responsible for the actions of any AI client you have authorized. "The AI did it" is not a defense to a violation of these Terms.


Token Lifecycle, Scope, and Revocation

OAuth tokens issued to AI clients are scoped to the tool surface you approved during consent. Tokens are subject to expiration and to revocation by you at any time through your CrossTrade account settings. CrossTrade may also independently revoke, narrow, or suspend tokens at any time, including without prior notice, if we detect suspected misuse, abuse, security risk, regulatory concern, or any breach of these Terms.

Revoking a token immediately invalidates any in-flight or future tool calls from that AI client. It does not, however, undo trades that have already been placed. You remain responsible for managing or unwinding any open positions or pending orders that resulted from prior AI activity.

You should treat OAuth tokens like account credentials. Do not share them. Do not embed them in untrusted third-party software. Do not paste them into shared chat sessions, public repositories, or any environment where they may be exfiltrated. CrossTrade is not liable for trades placed by unauthorized parties who obtained your tokens through your own failure to secure them.


No Guarantee of Compatibility or Continuity

The Model Context Protocol and the broader landscape of AI-client integrations are evolving rapidly. CrossTrade's MCP tool surface, OAuth scopes, rate limits, authentication flow, and behavior may change at any time, with or without advance notice. Third-party AI clients may also change their behavior, model versions, tool-handling logic, or access requirements without notice to CrossTrade or to you.

CrossTrade reserves the right to add, remove, modify, restrict, or temporarily suspend any AI-related feature or integration for any reason, including without limitation safety, regulatory compliance, abuse prevention, infrastructure capacity, or commercial considerations. CrossTrade is not liable for any losses, missed opportunities, or trading consequences arising from changes to AI features or from the unavailability of AI integrations.


Cross-References to Other Agreements

This AI Trading Agents Disclaimer is in addition to and not in lieu of every other CrossTrade legal agreement that applies to you. In particular:

  • The Terms of Service govern your overall relationship with CrossTrade, including the "AI Agent Access & Authorization" section.
  • The Trading Disclaimer covers automated-trading, latency, execution, and platform risks that apply equally to AI-initiated activity.
  • The Privacy Policy describes what data CrossTrade collects, retains, and transmits, including the section on third-party AI providers.

In the event of any conflict between this disclaimer and the Terms of Service, the Terms of Service control.
