Version 2026-10.
This addendum applies when you connect a CrossTrade account to a product built and operated by an independent company or person that uses CrossTrade's Partner Platform (the "Partner"). It is a click-through condition under Sections 9 and 11 of the CrossTrade Terms of Service. The CrossTrade Terms of Service, the Trading Disclaimer, the Privacy Policy and, where the Partner's product uses artificial intelligence or automated decision-making, the AI Trading Agents Disclaimer apply to your account in full. This addendum adds to them, and for your connection to the Partner it controls where it covers the same subject. "CrossTrade", "we" and "us" mean CrossTrade LLC, a Wyoming limited liability company.
1. Who you are dealing with
- The Partner's product is the Partner's own. CrossTrade provides the Partner with technology: account creation, the hosted Connect page you are using now, and an interface that acts on your behalf within the limits you approve below. "Powered by CrossTrade" describes that technology and nothing more.
- CrossTrade did not build, review, test, approve, supervise or endorse the Partner's product, strategies, signals, advice, software, automation, marketing, fees, support or security, and makes no representation about the Partner's identity, qualifications, experience, honesty, solvency, registration or licensing. Check these for yourself. If the Partner's activities require registration with the Commodity Futures Trading Commission (CFTC), the National Futures Association (NFA), the Securities and Exchange Commission (SEC) or any other regulator, that is the Partner's responsibility, and you should ask the Partner about it.
- CrossTrade is a technology provider only. CrossTrade is not a broker, dealer, futures commission merchant, introducing broker, commodity trading advisor, investment adviser, exchange or fiduciary, and is not registered with the CFTC, NFA, SEC or any other regulator in any capacity. CrossTrade does not give investment, trading, tax or legal advice, does not assess suitability, does not manage or hold your funds, and does not supervise the Partner.
- CrossTrade is not a party to any agreement between you and the Partner, does not set or collect the Partner's prices, and is not responsible for the Partner's billing, refunds, support, promises or conduct. Questions, complaints and refund requests about the Partner's product go to the Partner. A dispute with the Partner is between you and the Partner; CrossTrade will not mediate it or represent you in it.
2. Your account
- If the Partner created this CrossTrade account for you, the account is managed through the Partner while your seat with the Partner is open. You will not receive CrossTrade marketing email, and you use the Partner's product rather than signing in to CrossTrade directly. CrossTrade still sends you the security, verification and legal notices needed to keep the account safe, such as the email verification code on this page, and may contact you, restrict the account or end your seat whenever CrossTrade considers it necessary to protect you, other customers or the service, or to comply with law.
- When your seat with the Partner ends for any reason, including the Partner's non-payment or termination, the account becomes an ordinary CrossTrade account that you control, on the free plan unless you subscribe yourself. CrossTrade will tell you how to set a password and sign in, and will send you CrossTrade news only if you choose to receive it.
- If you connected an existing CrossTrade account, it stays yours throughout. An account that already has its own paid subscription cannot be connected. While the seat is open the Partner funds your account's access and your plan reflects the Partner's program; when the seat ends your account returns to the free plan, and anything you buy from CrossTrade afterwards is your own purchase under the Refund & Cancellation Policy.
- One person, one account. You must be at least eighteen (18) years old, must be the owner of the email address and of every broker login you link, and must give accurate information. Keep your CrossTrade password to yourself and never share a one-time code with anyone, including the Partner. CrossTrade may refuse, suspend or close an account that does not meet these requirements.
3. What you are authorizing
- You choose the scope on the next step. You decide which broker accounts the Partner's product may see and what it may do with them: read positions, orders and balances; place, change, cancel and flatten orders; or set up and change automation such as monitors, copiers and order templates. The Partner receives an access token limited to exactly that scope and to the trading environments (simulated or live) enabled for the Partner.
- Every action under your authorization is your action. Orders placed, changed or cancelled by the Partner's product through your authorization are your orders, placed in your account with your broker, at your risk, exactly as if you had placed them yourself. This is the same principle that applies to AI clients under Section 17H of the Terms of Service. CrossTrade is a technical conduit between the Partner's product and your broker; CrossTrade does not review, validate, filter, delay or second-guess the Partner's instructions, and does not know whether they are right for you.
- The Partner never receives your passwords. Your broker login is linked with the broker directly on this page, and the Partner's product never sees your CrossTrade password or your broker credentials.
- You can withdraw your authorization at any time in your CrossTrade account under Connected apps. Withdrawal stops the Partner's product from taking further action, but it does not cancel orders already working, close positions already open, or undo anything already done; managing those is your responsibility. CrossTrade may also revoke, narrow or suspend the Partner's access at any time, with or without notice, for security, legal or abuse-prevention reasons, and your seat may end at any time if the Partner's relationship with CrossTrade ends.
4. Trading risk, and that you accept it
- The Trading Disclaimer applies in full, including its statements required by CFTC Rule 4.41. Futures, options and foreign-exchange trading carry substantial risk and are not suitable for everyone. You can lose all of, or more than, the money you put in. Trade only with risk capital. Past performance is not indicative of future results.
- Automated trading can and does fail. Software errors in the Partner's product, network and server outages, latency, rate limits, partial fills, slippage, duplicated or missing orders, stale or incorrect account data, broker and platform failures, and changes to third-party systems can all produce trades or losses you did not intend. If the Partner's product uses artificial intelligence, it can also act on fabricated, misread or outdated information, as the AI Trading Agents Disclaimer describes.
- Risk controls are not guarantees. Any stop, flatten, loss limit, monitor or similar control offered by the Partner or by CrossTrade is best-effort automation that depends on systems outside CrossTrade's control and on market conditions, and may fail to trigger, trigger late, or execute at a materially worse price. Section 17I of the Terms of Service applies. Use your broker's own protective orders and account-level controls as well.
- You must monitor your accounts at all times. Never assume the Partner's product is working correctly, and never leave it unsupervised in a live account with capital you cannot afford to lose. Test with a simulated account first.
- Proprietary trading firm and broker rules are yours to keep. If you connect an evaluation or funded account, you are responsible for knowing and following that firm's current rules on automation, copying and third-party tools. Neither the Partner's product nor any CrossTrade feature is a representation that a use is permitted by a firm, and CrossTrade is not liable for any failed evaluation, revoked funding, denied payout or other consequence a firm imposes. Section 7A of the Terms of Service applies.
- No guarantee from CrossTrade. CrossTrade makes no promise about the profitability, accuracy or safety of the Partner's product. Any guarantee, projection or claim the Partner makes is the Partner's alone.
5. No investment advice from CrossTrade
Nothing CrossTrade provides in connection with this connection is investment advice, a recommendation, an offer or solicitation to buy or sell any instrument, or a determination that the Partner's product is suitable for you. CrossTrade does not know your financial situation, objectives or risk tolerance and does not assess them. Whether to connect, what scope to grant, and whether to keep the connection are your decisions alone.
6. Fees
The Partner pays CrossTrade for your seat. CrossTrade does not charge you for this connection. Any amount you pay the Partner is between you and the Partner, and CrossTrade is not responsible for the Partner's charges, billing or refunds.
7. Your information
- What CrossTrade shares with the Partner: the status of your enrollment and connection; the email address and name supplied when your account was created or connected; any customer reference the Partner assigned to you; the identifiers of the broker accounts you chose to share; and the results and status of the actions the Partner's product takes under your authorization. CrossTrade does not share your CrossTrade password, your broker credentials, or data outside the scope you authorized.
- Two privacy notices apply. CrossTrade's processing of your information is governed by the CrossTrade Privacy Policy. The Partner's handling of your information, including anything it collects in its own product, is governed by the Partner's own privacy notice, which you should read. If the Partner's product sends your data to third-party AI providers or other vendors, that is the Partner's doing and is governed by those providers' terms.
- What CrossTrade records. CrossTrade records the version and content hash of each document you accept, the time, network address and session of your acceptance, the scope you authorize, and security and audit logs of actions taken under your authorization, and may show the Partner the fact and status of your authorization.
- Your rights. You may exercise the rights described in the Privacy Policy and request deletion through CrossTrade's Account and Data Deletion page. While your account is managed through the Partner, the Partner may also make certain requests about it.
8. Your responsibilities
You will: use the connection only with broker accounts you own and are permitted to trade; comply with the Terms of Service, the Trading Disclaimer, all applicable laws, and the rules of every broker, exchange, platform and proprietary trading firm whose accounts you use; keep your credentials and devices secure; monitor your accounts and the Partner's activity in them; promptly withdraw an authorization you no longer want; handle your own tax reporting and recordkeeping; and not use the connection for market manipulation, pay-to-pass schemes, trading for other people, or any activity the Terms of Service prohibit.
9. Disclaimers, limitation of liability and release
- As is. The connection, the Partner Platform and everything CrossTrade provides in connection with them are provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement. CrossTrade does not warrant that the connection will be uninterrupted, timely, secure or error-free, or that any order will be delivered or executed at any time or price. Sections 16, 18, 20, 21 and 31 of the Terms of Service apply to this connection.
- No liability for the Partner. To the fullest extent permitted by law, CrossTrade is not liable for anything the Partner or the Partner's product does or fails to do, including its advice, signals, strategies, software, automation, security, availability, billing, promises or conduct, or for any trading loss, missed opportunity, account consequence or other damage arising from your authorization or from orders placed under it.
- Limits. To the fullest extent permitted by law, CrossTrade and its affiliates, members, managers, officers, employees, agents, licensors and suppliers are not liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, lost data or trading losses, however caused. CrossTrade's total liability to you for everything relating to this connection is limited to the greater of the amounts you paid CrossTrade in the twelve (12) months before the claim and one hundred U.S. dollars (USD $100). Where you have paid CrossTrade nothing, the limit is USD $100. Where the law does not permit a limitation, CrossTrade's liability is limited to the smallest amount the law allows.
- Release. To the fullest extent permitted by law, you release and discharge CrossTrade and the persons listed above from every claim, demand, loss and liability arising out of or connected with the Partner, the Partner's product, your authorization and the actions taken under it. You waive the benefit of any law that would limit a general release to claims you know about at the time, including California Civil Code Section 1542 or any similar law.
- Indemnity. Section 19 of the Terms of Service applies, including for any claim arising from your breach of this addendum, your misuse of the connection, or your violation of a broker's, exchange's, platform's or proprietary trading firm's rules.
10. Disputes
Section 22 (Arbitration Agreement) and Section 23 (Choice of Law and Venue) of the Terms of Service apply to every dispute between you and CrossTrade relating to this connection: Wyoming law governs, disputes are resolved by binding individual arbitration administered by the American Arbitration Association in Wyoming, you and CrossTrade each waive a jury trial and class, collective or representative proceedings, and claims must be brought within one (1) year. Disputes between you and the Partner are governed by whatever you agreed with the Partner.
11. Changes and your acceptance
CrossTrade may publish a new version of this addendum. If a new version applies to an existing connection, you will be asked to accept it the next time acceptance is required, and continuing to use the connection after notice is acceptance. Your acceptance of this addendum is given electronically and has the same effect as a handwritten signature. Questions about this addendum go to [email protected]; questions about the Partner's product go to the Partner.
By accepting these terms you confirm that you have read and understood this addendum, the CrossTrade Terms of Service and the Trading Disclaimer, that you meet the requirements in Section 2, and that you agree to be bound by them.
